These Terms of Service ("Terms") govern your use of the website and services of THE ATHLETES CORNER LLC, doing business as Athletes Corner ("Athletes Corner," "we," "us," or "our"). By accessing our website, submitting a form, enrolling a youth, or opting in to text messages, you agree to these Terms. If you do not agree, please do not use our website or services.

By using our website, contacting us, enrolling a youth, or opting in to text communications from Athletes Corner, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of Services

Athletes Corner is a community-based therapeutic mentorship program for youth ages 8 to 18. We pair young people with trained therapeutic mentors and provide licensed clinical oversight, delivering relationship-based, strengths-focused support through sports and skill-building. For eligible families, services are billed through MassHealth and are provided at no cost. We may also send text message communications to parents, guardians, or adults who have opted in.

3. Text Message (SMS) Terms

3.1 Program Description

By opting in to our text message program, you agree to receive text messages from Athletes Corner, which may include appointment reminders, scheduling and enrollment updates, program information, and important announcements.

3.2 Opt-In

You opt in by submitting your mobile phone number through our form and checking the consent box. Your opt-in is your express consent under the Telephone Consumer Protection Act (TCPA) and applicable rules, and must be provided by a parent, legal guardian, or adult.

3.3 Opt-Out

You may opt out at any time by replying STOP to any text message. You will receive one final confirmation message, and no further messages will be sent except as required by law.

Reply HELP to any text message for assistance, or contact us using the information in Section 12.

3.5 Costs

Message and data rates may apply based on your mobile carrier's plan. Athletes Corner is not responsible for charges from your carrier.

3.6 Frequency

Message frequency varies based on your interactions with us and a youth's program schedule.

3.7 Carrier Liability

Wireless carriers are not liable for delayed or undelivered messages.

4. Eligibility & Parental Consent

Our website and text message program are intended for adults 18 years of age or older. Services are provided to youth ages 8 to 18, but all enrollment, communication, and text message opt-in must be completed by a parent or legal guardian who is at least 18 years old and authorized to consent on the youth's behalf. By enrolling a youth, you confirm that you are that youth's parent or legal guardian or are otherwise authorized to act on their behalf.

5. Enrollment & Participation

• You agree that the information you provide during enrollment is accurate and complete.
• Enrollment and continued participation may depend on eligibility, including MassHealth coverage and program availability.
• Athletes Corner may decline or end participation at its discretion, including where required for the safety of participants or staff.

6. Intellectual Property

All content on our website and in our programs, including text, graphics, logos, images, and materials, is the property of Athletes Corner or its licensors and is protected by copyright, trademark, and other laws. You may not reproduce, distribute, or create derivative works without our prior written permission.

7. Acceptable Use

When using our website or services, you agree not to:

• Provide false or misleading information
• Harass, threaten, or harm participants, staff, or others
• Violate any applicable local, state, or federal law
• Interfere with the operation or security of our website or systems
• Attempt to gain unauthorized access to any part of our systems

From time to time we may capture photographs or video during programming. Because we work with minors, we use images of a youth only where a parent or legal guardian has given consent, which may be provided or declined during enrollment. A parent or guardian may withdraw consent at any time by contacting us, and we will stop using the youth's image in future materials.

9. Disclaimer of Warranties

Our website and services are provided on an "as is" and "as available" basis. Athletes Corner makes no warranties, express or implied, regarding the accuracy, reliability, or availability of our website or services.

10. Limitation of Liability

To the fullest extent permitted by law, Athletes Corner will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or services, including loss of data or unauthorized access to information.

11. Indemnification

You agree to indemnify, defend, and hold harmless Athletes Corner and its members, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of our services or your violation of these Terms.
